DHgate.com's Notice on Intellectual Property Complaints

In view of the increase in appeal-related inquiries regarding intellectual property rights, we hereby reiterate the relevant appeal rights and regulations. If you have any appeal needs, please submit your appeal in a timely manner in strict accordance with the complaint system-appeal process requirements.

1. Complaint Channels

For each complaint, the party complained against has only one opportunity to appeal, and it can only be submitted through the Intellectual Property Complaint System - Appeal Process.

[Waiting for the respondent to handle] stage: After receiving the relevant complaint, the respondent can view the complained product and the complainant's IP in the intellectual property complaint product. If the respondent does not recognize the infringement, he or she can submit the complaint materials within the response period.

[Waiting for the complainant to handle] stage: The complainant reviews the complaint materials of the complained party and handles the complaint. If the complainant accepts the complaint/does not respond within the time limit, the complaint is successful. If not, the platform will enter the decision stage.

[Waiting for DHgate to process] stage: When making a ruling, the platform will review the appeal materials again and make a comprehensive determination on whether the complaint is valid based on the materials provided.

II. Complaint Materials

The appeal should select the reason for the appeal and submit the appeal materials and statement truthfully. The appeal materials are based only on the materials submitted by the system and cannot be supplemented after submission. Please fill in the appeal materials carefully, completely and effectively.

If you believe that the product does not infringe or you have your own intellectual property rights, please submit the appeal materials and relevant rights proof materials as required. For specific appeal requirements, please refer to the appeal system.

Tips for complaint materials: If you believe that the product's trademark/patent/copyright or unregistered images are not infringing, the party complained against should confirm that its products (including but not limited to products and graphic descriptions) do not contain the complaining party's corresponding trademark/patent/copyright or unregistered images, etc., and provide specific inconsistent comparison materials, etc. It is recommended to supplement the "Comparative Analysis Description" and upload the complaint statement as required by the system.

If you claim that it was delivered by mistake, please specify the type of non-infringement and provide supporting materials. You can clearly indicate the point of misdelivery, such as writing "×× was mistakenly delivered as ××".

III. Complaint Submission

The appeal will be strictly judged based on the appeal materials submitted. If the materials provided are incomplete or insufficient to prove non-infringement, or if you cannot prove that you have legal intellectual property rights, the appeal may fail. After the appeal fails, you cannot supplement the appeal materials again and there will be no opportunity for supplementary appeal.

For sellers who obviously make malicious appeals or abuse their appeal rights, the platform will accumulate such appeal data and evaluate and impose penalties.
